Privacy Notice

Dear Sirs,

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: the “GDPR”), we hereby inform you that:

  1. The controller of your personal data under the agreement (hereinafter: the “Controller”) is Formika Sp. z o.o., with its registered office in Brwinów, ul. Św. Jerzego 9, 05-808 Brwinów, Poland, Tax ID (NIP): 1070017779, National Court Register (KRS): 374305.

  2. If, under the agreement, you have provided us with the personal data of your employees or associates/co-workers, please be informed that this information clause also applies to them and should be made available to them by you.

  3. The personal data provided by you will be processed for the purposes of performing the agreement, for the provision of other services based on consent granted, in order to fulfil obligations arising from generally applicable laws, and for purposes resulting from the legitimate interests pursued by the Controller, in particular for the performance of the agreement, handling complaints, and establishing, pursuing, or defending mutual claims—in accordance with Article 6(1)(a), (b), (c), and (f) GDPR.

  4. Your personal data will be processed for the duration of the agreement or until the expiry of mutual claims arising from the agreement.

  5. The recipients of your personal data will be exclusively entities authorised to obtain personal data under separate provisions of law, the Controller’s authorised employees/associates, providers of technical and organisational services, and entities involved in the performance of the agreement.

  6. Your personal data will not be transferred to a recipient in a third country or to an international organisation.

  7. You have the right to access the content of your data and the right to rectification, erasure, restriction of processing, data portability, to object, and to withdraw consent at any time—without affecting the lawfulness of processing based on consent before its withdrawal.   8. You have the right to lodge a complaint with a supervisory authority if you consider that the processing of your personal data infringes the GDPR or other provisions governing the processing and protection of personal data.

  9. Providing your personal data is voluntary and results from the concluded agreement and ongoing business cooperation; however, failure to provide such data may result in a partial or complete inability of the Controller to perform the agreement.

  10. The personal data you provide will not be used for automated decision-making based on personal data processed in connection with the performance of the agreement by the Controller; in particular, your data will not be subject to profiling.
